Common Traffic Violations and Penalties in Minneapolis
Traffic violations in Minnesota typically involve fines. The more serious the violation, or if it’s a repeat violation, the more serious the fine may be.
Importantly, Minnesota doesn’t use a straightforward "points system" like some other states. Instead, it uses a system established under the Habitual Violator Law that targets drivers with multiple serious offenses. These drivers are at a higher risk of a license suspension, in addition to fines for traffic violations.
Common traffic violations and penalties:
- Speeding. Exceeding the speed limit can result in fines ranging from $40 to $385, depending on the severity of the offense. Repeat offenders may face increased fines and possible license suspension.
- Running a red light. This violation typically results in a fine of around $130. However, if it leads to an accident, the penalties can include higher fines and possible criminal charges.
- Failure to yield to pedestrians. Failing to yield to pedestrians in crosswalks can result in a fine of approximately $100.
- Following too closely. This violation can result in a $135 fine.
- Failing to wear a seatbelt. All drivers and occupants must wear a seatbelt regardless of age or seating position. If any individual isn’t properly wearing a seatbelt, the driver may be cited and fined $110. Exceptions may apply for certain vehicles, such as limousines and charter buses.
- Texting while driving. Texting while driving is illegal and can result in fines starting at $50 for a first offense and up to $225 for subsequent violations.
If you were cited for any of these traffic violations, our traffic ticket lawyers in Minneapolis at Brockton D. Hunter P.A. can help. With many years of combined experience, our legal team has what it takes to help you fight your traffic ticket.
Will I Go to Jail If I Get a Traffic Ticket?
It’s highly unusual for traffic violations to result in jail time. Traffic tickets involve infractions such as speeding, running a red light, or failing to signal. Because these are not considered criminal acts such as reckless driving or DWI, they are treated as infractions punishable with fines, court-ordered awareness courses, license suspension and revocation, and other administrative consequences aside from imprisonment.
However, legal complications from a traffic ticket could lead to jail time. If someone fails to pay a ticket or ignores court orders related to a traffic offense, a judge may issue a bench warrant, and the consequences can include jail time. Taking traffic tickets seriously and addressing them promptly is important to avoid unnecessarily escalating legal issues.
Will I Lose My Driver's License Because of a Traffic Violation?
It’s possible, but you generally won't face immediate suspension for minor violations. If you have repeated offenses or serious violations, however, the state may suspend or revoke your driver's license.
Convictions for crimes such as DWI, reckless driving, or leaving the scene of an accident can also result in license revocation. If you’re concerned about your specific situation, check your driving record and consult a traffic ticket lawyer in Minneapolis for guidance.
